Terms of Service

These terms cover your use of Built By Machine ("we", "us"), including the website at bbm.build, the app, and the apps you build and publish with it. By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.

1. Your account

• You must be at least 18 years old, or the age of majority where you live, to create an account.
• You are responsible for what happens under your account and for keeping your sign-in methods secure.
• If you use Built By Machine for a business, you confirm you are allowed to accept these terms for it.

2. Plans, free trial and automatic renewal

• Plans. Paid plans are billed monthly at the price shown on the pricing page when you sign up. Prices are in US dollars and do not include any taxes that may apply.
• Free trial. Paid plans start with a 7-day free trial, and a payment card is required to start it. During the trial you can build, but publishing, using your app live, and exporting code start only when your paid plan starts. You can end the trial early and start your plan at any time.
• Automatic renewal. Unless you cancel before the trial ends, your card is charged the plan's monthly price when the trial ends, and then again every month until you cancel.
• Cancelling. You can cancel at any time online, in the app under Billing → Manage billing. If you cancel during the free trial, you will not be charged. After you cancel you will not be charged again.
• Included usage. Each paid plan includes a set amount of usage each month. Unused usage does not carry over to the next month. When it runs out, work that needs usage pauses until your plan renews, you change plans, or you buy a Build Pack. We do not charge automatic overage fees.
• Build Packs. A Build Pack is a one-time purchase that adds extra usage. It is used only after your monthly usage runs out and expires 12 months after purchase. Build Packs are available on paid plans only, not during the free trial, and never renew automatically.
• Failed payments. If a payment fails, publishing, live use and code export may be paused until the payment goes through.
• Price changes. If we change a plan's price, we will tell you before the new price applies to you, and you can cancel before it does.
• Refunds. Except where the law requires otherwise, payments are not refundable, including for partial months, unused usage, and unused Build Packs. If you think you were charged by mistake, contact us and we will look into it.

3. Your content and your apps

• You keep the rights you have in the content you give us, such as your ideas, text, images and files.
• You give us permission to store, copy, process and display that content, and to host the apps you publish, only as needed to run the service for you.
• We do not claim ownership of the apps and code generated for your projects. Generated code may include open-source software that comes with its own license terms.
• You are responsible for your apps: their content, how they are used, the data they collect, and following the laws that apply to them. That includes giving your app's users any privacy notice or terms they need.

4. Generated results can be wrong

Briefs, code, text, images and answers in Built By Machine, including Blaine's replies, are generated automatically by software. Automated results can contain mistakes, security problems, or content that is inaccurate, incomplete, or similar to other material. Review and test your app, and check any important information yourself, before you publish or rely on it.

5. Security and quality checks

Apps go through automated security and quality checks before they can be published. These checks help catch common problems, but they cannot find every issue. They are not a guarantee that an app is secure, error-free, or legally compliant, and they are not a certification or audit of any kind. Do not use Built By Machine to build apps that store health records, payment card numbers, or other data that requires special legal protection.

6. Acceptable use

You agree not to use Built By Machine to:

• break the law, or help anyone else break it;
• infringe anyone's intellectual property, privacy, or other rights;
• build or host malware, phishing, spam, scams, or content that harms or harasses people;
• impersonate a person or company, or suggest a connection or endorsement that does not exist;
• try to get around usage limits, security, or access controls, or disrupt the service; or
• resell or share access to your account without our permission.

We may remove content or unpublish an app that breaks these rules.

7. Hosting and availability

We work to keep the service and your published apps running, but we do not promise any particular uptime or speed, and the service may be unavailable at times. We may change, add or remove features. If we stop offering a paid feature you rely on, we will try to give you reasonable notice.

8. Other companies' services

Some features rely on other companies, such as GitHub and Stripe. Their terms apply to your use of their services. Product names and trademarks belong to their owners, and mentioning them does not mean they endorse Built By Machine.

9. Ending your account

You can delete your account at any time in Settings → Delete Account, which also cancels any active subscription. We may suspend or close an account that breaks these terms, or where we are required to by law.

10. No warranty

TO THE EXTENT THE LAW ALLOWS, BUILT BY MACHINE, THE APPS AND CODE IT GENERATES, AND ITS SECURITY AND QUALITY CHECKS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY GENERATED APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY APP BUILT WITH IT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some places do not allow some of these limits, so they may not all apply to you.

12. Changes to these terms

We may update these terms from time to time. The "Last updated" date above shows when they last changed. If a change is significant, we will let you know before it takes effect. Continuing to use the service after a change takes effect means you accept the new terms.
